Terms of Service

1. General Terms

These Terms of Service incorporate the General Terms and Conditions published at https://mitjamartini.com/terms/, specifically the following Bitkom modules:

• AV (Allgemeine Vertragsbedingungen) — General Terms
• SaaS (Software as a Service)

Where these WeDoodle-specific terms conflict with the general terms, these WeDoodle-specific terms take precedence.

2. Service Description

WeDoodle is an AI-powered animation service that transforms uploaded images ("doodles") into short animated video clips. The service uses artificial intelligence models to moderate content, generate animation prompts, and produce video output.

3. Credits and Pricing

• The service operates on a prepaid credit model. 1 credit = 1 second of animation.
• Credits are purchased in packs via our payment provider (see §6).
• Credits expire 12 months after purchase or grant.
• New users receive a one-time welcome grant of free credits.
• Credit balances are non-transferable between accounts.
• Unused credits are not refundable except as described in the refund policy (§7).

4. AI-Generated Content

• Video output is generated by AI models (Google Veo) and may vary in quality and interpretation.
• WeDoodle does not guarantee that the generated animation will match the user's expectations or description.
• All uploaded content is screened by an automated content moderation system. Content deemed inappropriate may be rejected. Credits are refunded for rejected content.
• Users retain ownership of their uploaded doodles. AI-generated video output is licensed to the user for personal, non-commercial use.
• WeDoodle may use anonymized, aggregated usage data to improve the service, but will not use individual doodles or videos for AI training without explicit consent.

5. Published Content and Marketing Use

Users may choose to make their videos publicly accessible via a share link. Public videos may be viewed by anyone, including non-registered users. Users can unpublish shared videos at any time. WeDoodle is not responsible for third-party use of content that was made public by the user.

When you publish a video, you grant WeDoodle a non-exclusive, royalty-free right to use your uploaded doodle and the generated video for marketing purposes (for example, showcasing WeDoodle on our website or social media). You may revoke this right at any time by emailing hi@mitjamartini.com.

6. Acceptable Use

Users must not upload content that:

• Depicts violence, gore, or harm to people or animals
• Contains sexual or suggestive content
• Contains hate speech, discrimination, or harassment
• Contains real photographs of identifiable people (especially children)
• Contains personal information (names, addresses, phone numbers)
• Promotes illegal activities, drugs, or weapons
• Infringes on third-party intellectual property rights

WeDoodle reserves the right to reject content, block sharing, and suspend accounts that violate these terms.

7. Payment

Payment processing and order management for WeDoodle is handled by our Merchant of Record, Polar Software, Inc. ("Polar"). Polar handles checkout, invoicing, and sales tax collection and remittance.

8. Refund Policy

• Credits consumed for video generation are non-refundable, as the AI processing cost is incurred at the time of generation.
• Credits refunded automatically: if content moderation rejects your upload, or if video generation fails, your credits are restored automatically.
• Unused credits: if you have purchased credits and have not used them, you may request a refund within 14 days of purchase by contacting Polar support.
• After 14 days, unused purchased credits are non-refundable but remain valid until their expiry date (12 months from purchase).
• Free welcome credits have no monetary value and are non-refundable.

Polar, as our Merchant of Record, may independently grant refunds in accordance with their Buyer Terms and applicable consumer protection laws.

9. Account and Data

• Accounts are created via email magic link. No password is stored.
• You may request deletion of your account and all associated data by emailing hi@mitjamartini.com. Account deletion is permanent and includes all uploaded doodles, generated videos, and credit history.
• WeDoodle reserves the right to delete inactive accounts after 24 months of inactivity, with 30 days email notice before deletion.

10. Limitation of Liability

• WeDoodle is provided "as is" without warranties of any kind.
• Liability is limited to the amount paid by the user in the 12 months preceding the claim.
• WeDoodle is not liable for AI model availability, quality variations, or third-party service outages (Google, Polar, BunnyCDN).

11. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. For consumers resident in the EU, mandatory consumer protection laws of your country of residence apply.
